Rahul Gandhi in trouble for his statement on China; Will he lose his Lok Sabha membership?

New Delhi: Leader of Opposition in Lok Sabha Rahul Gandhi said that China still occupies more than 4,000 square kilometers of land. Prime Minister Narendra Modi rejected these claims, while the army has expressed disagreement with PM Modi. Union Minister Kiren Rijiju objected to these claims of Rahul Gandhi and said that you cannot say whatever you want in the House. This is not right and this is a serious matter. After this, BJP MP Nishikant Dubey demanded to bring a privilege violation motion against him. MP Dubey has also written a letter to Lok Sabha Speaker Om Birla for the motion.

If a Member of Parliament feels that parliamentary privilege has been violated or misused by any (other) member, then he can complain to the Chairman of Rajya Sabha or the Speaker of Lok Sabha through a privilege motion. A privilege motion is presented on behalf of a member when the member feels that a minister or a member has violated the privilege of the House or one or more of its members by hiding the facts of a case or by giving wrong or distorted facts.

The purpose of a privilege motion is to protect the dignity and rights of the Parliament and its members. Through this process, MPs can complain against any such action taken by a member of the House, an officer or any other person which has violated the privileges of the Parliament.

These are parliamentary privileges, know that a member has freedom of expression in Parliament, a member is immune from any proceedings in any court in respect of anything said or vote given by a member in Parliament or any of its committees. A person is given immunity from proceedings in any court in respect of the publication of any report, letter, vote or proceedings by or under the authority of either House of Parliament. Courts are prohibited from investigating the proceedings of Parliament.
